This paper focuses on the use of ‘black box’ AI in medicine and asks whether the physician needs to disclose to patients that even the best AI comes with the risks of cyberattacks, systematic bias, and a particular type of mismatch between AI’s implicit assumptions and an individual patient’s background situation.Pacecurrent clinical practice, I argue that, under certain circumstances, these risks do need to be disclosed. Otherwise, the physician either vitiates a patient’s informed consent or violates a more general obligation (...) to warn him about potentially harmful consequences. To support this view, I argue, first, that the already widely accepted conditions in the evaluation of risks, i.e. the ‘nature’ and ‘likelihood’ of risks, speak in favour of disclosure and, second, that principled objections against the disclosure of these risks do not withstand scrutiny. Moreover, I also explain that these risks are exacerbated by pandemics like the COVID-19 crisis, which further emphasises their significance. (shrink)

Biological modalities (e.g., biological possibility, necessity and counterfactuality) play an important explanatory role in biological practice. However, biological modalities lack truth conditions and the inferential relationship between biological and other modalities is unclear. This thesis addresses these problems, first, by improving upon Daniel Dennett's Library of Mendel. Second, a family of modal logics is introduced. In the simplest model, states are interpreted as codons, the binary relation is interpreted as single substitution mutation and the valuation induces a partition of blocks (...) of codons that code for some amino acid. In addition, the proposed framework allows for a grading of biological possibility and captures various competing notions of biological possibility. Applications include a model checker and a lawless Lewis-style semantics for biological counterfactuals. In short, this thesis lays the groundwork for a theory of biological modalities. (shrink)

ZusammenfassungFür die mittelhochdeutschen Romane um 1200 läßt sich eine spezifische sozialgeschichtliche Einbettung annehmen, die Konsequenzen für ein Modell literarischer Kommunikation hat. Im Zusammenspiel von Verfassern, geistlichen Beratern – dem Hofklerus – und zunächst einmal adligen Damen entstehen die Texte, denen eine hofklerikale Perspektive auf Fragen feudaladliger Existenz eignet: Die ästhetisch komplexen volkssprachigen Texte lassen klare Problembezüge erkennen. Im Rahmen dieses Modells literarischer Kommunikation wird der Erec Hartmanns von Aue als Absage an Versuche ritterlicher Selbsterlösung gedeutet, denen der sich der göttlichen (...) Gnade öffnende Wille des demütig Gläubigen gegenübergestellt wird. Der Tristan Gottfrieds von Straßburg scheint mit Blick auf die Protagonisten ein Negativexempel zu entwickeln, wobei durch suggestive Gestaltungsdynamiken das Abrücken der edelen herzen von Tristan und Isolde zunächst verhindert und dann umso stärker forciert wird.A specific social-historical embedding can be assumed for the Middle High German novels around 1200, which has consequences for a model of literary communication: In the interplay of authors, spiritual advisers and first of all noble women, the texts are created for which a courtly-clerical perspective on questions of feudal noble existence is suitable. The aesthetically complex vernacular texts focus on certain problems. In the context of this model of literary communication, Hartmann of Aue’s Erec is interpreted as a rejection of attempts at knightly self-redemption, which are contrasted with the will of the humble believer, which opens up to divine grace. Gottfried of Strasbourg’s Tristan seems to tell of a negative example with regard to the protagonists, whereby the edele herzen move away from Tristan and Isolde only in an aesthetic process of reception. Surveys of the German public have revealed a high acceptance of social freezing, i.e. oocyte conservation without medical indication. Up to now, there are no investigations available on the experiences and attitudes of health professionals towards social freezing. Between August 2015 and January 2016, we surveyed gynecologists Germany-wide on the topic social freezing. Five gynecologists specialized in reproductive medicine and five office-based gynecologists in standard care were chosen for the survey. The survey was conducted with an explorative, qualitative research design. (...) The demand for social freezing in Germany is low. With regard to their fertility age, most women attend consultations too late, they have only little previous knowledge and false expectations. The gynecologists consider it the duty of society and politics to provide for the compatibility of family and work. They relate late parenthood to disadvantages primarily for the children. A majority of the gynecologists interviewed tend to advise natural reproduction. Social freezing is often mistaken as a kind of fertility insurance. Thus, it is necessary that physicians inform women early about the possibilities and limitations of social freezing. In the first place, social freezing is not a medical or medical-ethical topic. Women consider the method as a possibility to ensure the compatibility of family and work. This compatibility should be mostly perceived as a political topic. It cannot be a medical task to solve this issue. In fact, a debate in society as a whole is necessary that includes all relevant actors. (shrink)

COVID-19 severity and mortality risk are greater for older adults whereas economic impact is deeper for younger adults. Using the Health Belief Model as a framework, this study used a web-based survey to examine how perceived COVID-19 susceptibility and severity and perceived efficacy of recommended health behaviors varied by age group and were related to the adoption of health behaviors. Proportional odds logistic regression was used to examine the relationship between age group and perceived COVID-19 susceptibility, severity, impact, and health (...) behavior efficacy and adoption. Structural equation modeling based on HBM constructs examined the relationships between health beliefs and behaviors. Data from 820 participants were analyzed. Middle-aged and older adults reported greater concerns about the personal risk of hospitalization and mortality, economic impact, and social impact of COVID-19 than young adults. Middle-aged adults also reported greatest concern for other age groups. Adoption and perceived efficacy of health behaviors was similar across age groups with few exceptions. Both middle-aged and older-adults were more likely to perceive their own and each other's age groups as responding adequately to COVID-19 compared to young adults. Structural equation modeling indicated perceived benefits of health behaviors were the primary driver of behavior uptake, with socioeconomic factors and perceived severity and susceptibility indirectly associated with uptake through their influence on perceived benefits. Overall, these results suggest adoption of health behaviors is very high with few differences between age groups, despite differences in perceived impact of COVID-19. Public health communications should focus on the benefits of health behaviors to drive adoption. (shrink)

It has become commonplace to consider start-ups originating from the science field usually referred to as academic spin-offs as drivers of innovation, productivity, and employment. However, only little is known about the process of spin-off creation (e.g., Goethner et al., 2009) and development (e.g., Mustar et al., 2006; Vohora et al., 2004). Specifically, there has not been sufficient empirical research directly comparing equivalently matched groups of academic spin-offs and non-academic start-ups in order to draw definitive conclusions on whether there are (...) specific growth paths of firms spun off from scientific research (Ensley & Hmieleski, 2005). Voluntariness is a necessary condition of valid consent. But determining whether a person consented voluntarily can be difficult, especially when people are subjected to coercion or manipulation, placed in a situation with no acceptable alternative other than to consent to something, or find themselves in an abusive relationship. This book presents a novel view on the voluntariness of consent, especially medical consent, which the author calls Interpersonal Consenter-Consentee Justification (ICCJ). According to this view, consent is voluntary if and only if (...) the process by which it has been obtained aligns with principles of interpersonal justification. ICCJ is distinctive because it explains voluntary consent neither as a 'psychological' concept indicative of the inner states of a person's mind (e.g. willingness or reluctance) nor as a 'circumstantial' concept indicative of a person's set of options. Rather, ICCJ explains the voluntariness of consent as an 'interpersonal' concept requiring the absence of illegitimate control within the interaction between the person giving consent and the person receiving it. In so doing, ICCJ further develops the notion of interpersonal justification, known from contractualist theories in moral philosophy, and introduces it to the debate on consent. The author employs a top-down approach, defending ICCJ's key characteristics on the basis of general theoretical arguments, as well as a bottom-up approach, supporting ICCJ in its application to clinical challenges such as nudging and manipulation, living organ donation, and clinical trials. Voluntary Consent will appeal to researchers and advanced students in normative ethics, bioethics, philosophy of law, behavioural psychology, and medicine. (shrink)

The role of intentions in motor planning is heavily weighted in classical psychological theories, but their role in generating eye movements, and our awareness of these oculomotor intentions, has not been investigated explicitly. In this study, the extent to which we monitor oculomotor intentions, i.e. the intentions to shift one’s gaze towards a specific location, and whether they can be expressed in conscious experience, is investigated. A forced-choice decision task was developed where a pair of faces moved systematically across a (...) screen. In some trials, the pair of faces moved additionally as soon as the participants attempted to gaze at one of the faces, preventing them from ever viewing it. The results of the experiment suggest that humans in general do not monitor their eye movement intentions in a way that allows for mismatches between planned gaze landing target and resulting gaze landing target to be consciously experienced during decision-making. The value problem for knowledge is the problem of explaining why knowledge is more valuable than mere true belief. The problem arises for reliabilism in particular, i.e., the externalist view that knowledge amounts to reliably acquired true belief. Goldman and Olsson argue that knowledge, in this sense, is more valuable than mere true belief due to the higher likelihood of future true beliefs (produced by the same reliable process) in the case of knowledge. They maintain that their solution works given (...) four empirical assumptions, which they claim hold “normally.” However, they do not show that their assumptions are externalistically acceptable; nor do they provide detailed evidence for their normality claim. We address these remaining gaps in Goldman and Olsson’s solution in a constructive spirit. In particular, we suggest an externalist interpretation of the assumptions such that they essentially spell out what it means for a broad range of organisms capable of belief-like representations to be epistemically adapted to their environment. Our investigation also sheds light on the circumstances in which the assumptions fail to hold and knowledge therefore fails to have extra value in Goldman and Olsson’s sense. The upshot is a deeper understanding of their solution as a contribution to naturalized epistemology and a strengthened case for its empirical validity. (shrink)

Building on the computer science concept of _code smells_, we initiate the study of _law smells_, i.e., patterns in legal texts that pose threats to the comprehensibility and maintainability of the law. With five intuitive law smells as running examples—namely, duplicated phrase, long element, large reference tree, ambiguous syntax, and natural language obsession—, we develop a comprehensive law smell taxonomy. This taxonomy classifies law smells by when they can be detected, which aspects of law they relate to, and how they (...) can be discovered. We introduce text-based and graph-based methods to identify instances of law smells, confirming their utility in practice using the United States Code as a test case. Our work demonstrates how ideas from software engineering can be leveraged to assess and improve the quality of _legal_ code, thus drawing attention to an understudied area in the intersection of law and computer science and highlighting the potential of computational legal drafting. The present paper provides the first reconstruction of the discussion between Martin Heidegger and Maximilian Beck, a former member of the Munich Circle of Phenomenology—a discussion that revolved around Beck’s interpretation of the “fundamental ontology” of Being and Time. Based upon the still unpublished correspondence between Heidegger and Beck, the essay first reconstructs their relation and then offers a meticulous discussion of Beck’s major criticism of Heidegger, i.e., “correlativism,” and the latter’s response to it in his courses of 1928.

ABSTRACT Between 1920 and 1922, the University of Bristol biochemist, Maximilian Nierenstein, published four papers in a series exploring the structure of catechin in the Journal of the Chemical Society. The Society then abruptly refused to accept any more of his papers on catechin, or any other subject. It provided him with no reasons for the embargo until 1925. It then transpired that Nierenstein was boycotted because it was deemed that he had not responded adequately to criticisms of his (...) work made by his rival in catechin research, the German natural products chemist, Karl Freudenberg. It was not until 1929 that, as a result of a petition by a group of his former Bristol pupils and friends, that Nierenstein was again permitted to publish in the Society’s journal. The paper explores the Chemical Society’s treatment of Nierenstein in detail, sheds new light on his career and his reaction to the Society’s unprecedented boycott, examines some of the structural chemistry involved in the disputes, and discusses whether Nierenstein’s research deserves the label of ‘bad science’. Maximilian Storz argues that physicians have an ethical obligation to recommend a plant-based diet to patients because such a diet: relieves certain chronic conditions, outperforms the Western diet (e.g. a diet containing animal products, among other things), and is ecologically sustainable. Contrary to these claims, I argue that a plant-based diet alone may not relieve chronic conditions, but potentially does so in combination with other lifestyle factors. With respect to the environment, I illuminate the landscape by discussing agricultural factors (...) consistent across animal and plant farming such as energy and water. I conclude that physicians ought to recommend a diet that follows the science; such a diet as I have claimed is exclusionary: it excludes processed foods, especially added sugars. Lifestylfe factors also deserve to be discussed in the medical encounter as their incorporation may lead to even better health outcomes. (shrink)

After highlight some functional, stylistic and historical data about the building idealized by Brazilian Archbishop Dom Duarte Leopoldo e Silva and designed by German engineer Maximilian Emil Hehl , will be highlighted the most important artistic aspects of architecture and Works of Art gathered in the paulist sacred buildings. In the present essay an attempt will be made at quickly reconstructing the debate between Dorion Cairns and the Munich phenomenologist Maximilian Beck, which bears on Husserl’s last published work, i.e., the Crisis of European Sciences and Transcendental Phenomenology. What is at stake is the value of Husserl’s phenomenology, with a focus upon the concepts of reason and rationality. As will be argued, the discussion between the two concerns the distinction, and relevant articulation, between what can be called “transcendental” (...) and “ontological” rationality respectively. In so doing, this paper aims at both interpreting a crucial moment in the history of 20th century phenomenology and bringing attention back to the life and work of Max Beck. (shrink)

This paper focuses on two aspects of Maximilian Beck’s philosophical reflection: his adherence to naive (phenomenological) realism and his claim to the autonomous existence of the affective qualities of the objectual world. Therefore, my contribution will be structured as follows: after a brief overview of Beck’s defence of naive realism (§2), I will attempt to show how, in his opinion, the affective qualities characterizing the world (i.e., the places and things we encounter) are in principle independent of the perceiver, (...) possessing an objectivity of their own. It is pertinent to mention here that Beck calls these affective qualities “objective moods” (objektive Stimmungen) (§3). After that, I will try to illustrate the “externalist” aspects of Beck’s theory of the apprehension of Stimmungen, highlighting its differences from the “projective empathy” theses that were circulating at the time, particularly in the version proposed by Theodor Lipps (§4). In the final section, I will present two arguments that Beck puts forward in support of his theory of the objectivity of the Stimmungen (§5). (shrink)

Die Vielfalt der mittelalterlichen Epik bietet ein fruchtbares Feld für gattungstheoretische Bestimmungen, das bislang in keiner Hinsicht ausgeschöpft ist. Da die mittelalterlichen Poetiken Gattungszuordnungen nicht zwingend festschreiben, bietet sich die Möglichkeit, auf der Basis einer induktiven Poetik mittelalterliche Werke in ihren generischen Verwandschaftsverhältnissen neu zu bestimmen. Entgegen dem Trend der älteren Forschung, Beschreibungspassagen in der mittelalterlichen Erzählliteratur eher negativ zu bewerten, soll in dem vorliegenden Beitrag die Bedeutung der Ekphrasis für Gattungsbestimmungen mittelalterlicher Erzähltexte herausgearbeitet und mit dem Begriff des „ekphrastischen (...) Romans“ ein neuer, auch die Antike und die Neuzeit umfassender Gattungstypus kreiert werden. Wer sich zünftig vorwiegend mit der modernen Literatur befasst, weiß um die gattungsbildende Funktion der Beschreibung im neoavantgardistischen Nouveau Roman, doch ist die generische Relevanz von ekphrastischen Passagen im mittelalterlichen Versroman noch weithin unerforscht und den Mediävisten unbekannt. Dass gerade der Beschreibung von Kunstwerken, auf die in letzter Zeit immer mehr der Begriff der Ekphrasis eingeschränkt wird, eine große poetische Relevanz zukommt, dokumentiert nicht nur ihre häufige Positionierung am Werkeingang oder ihre motivische Verknüpfung mit Passageriten des Protagonisten, sondern auch ihre besondere digressive Stellung im Erzählkontinuum mit komplexen Rahmen- und Binnenstrukturen, vor allem aber ihre für das ganze Werk repräsentative und quasi gattungsgenerierende Funktion als mise en abyme. Zudem sind die Beschreibungen von Kunstwerken in der Erzählliteratur des Hochmittelalters Zeichen einer neuen materiellen Sachkultur sowie symbolisch-diagrammatische Spiegelungen zeitgenössischer Weltbilder. Durch Partizipation an Formen der Visualität und Intermedialität sind die Ekphrasen auch mediengeschichtlich attraktiv und fungieren außerdem als Vehikel nicht nur einer werkimmanenten Poetik, sondern auch einer intrinsischen, Kunst wie auch Technik umgreifenden und universellen Ästhetik. Das hier rekonstruierte Genos des „ekphrastischen Romans“, das sich bis auf Homers,Ilias' zurückverfolgen lässt, die mit der Beschreibung von Achills Schild einen Prototypen liefert, zeigt bei aller Kontinuität einen besonderen Schub im Hochmittelalter, der neben byzantinischen Einflüssen u. a. mit einer ausgebildeten Exkurstheorie sowie Innovationen in der Erzähltechnik zusammenhängt, wie man z. B. aus dem,Erec' Hartmanns von Aue ersehen kann. Der „ekphrastische Roman“ zielt nicht auf einen nur an Aktionen interessierten Leser ab, der im Extremfall Haltepunkte im Erzählfluss überspringt, sondern auf einen Rezipienten, der sich geduldig mit der Dekodierung imaginärer Bildwelten befasst und bereit ist, sich in poetologische und kunstästhetische Reflexionen zu vertiefen, die eine eigene Ebene der Werkdeutung konstituieren. Whether meaning is compositional has been a major issue in linguistics and formal philosophy of language for the last 2 decades. Semantic holism is widely and plausibly considered as an objection to the principle of semantic compositionality therein. It comes as a surprise that the holistic peculiarities of scientific language have been rarely addressed in formal accounts so far, given that semantic holism has its roots in the philosophy of science. Heinrieh Scholz speaks (...) of "the Galenian syllogistic figure which has been attributed to him, probably wrongly." i j. W. Stakelum concludes his careful discussion of the matter with the categorical assertion that "Galen did not teach the fourth figure." ~ I. M. This datum casts some 28 HISTORY OF PHILOSOPHY 3) A Greek fragment was found around 1858 by Karl Prantl in a logical work of the Byzantine scholar Ioannes Italus (llth century) which says that Galen taught the existence of a fourth figure, adding sarcastically that he (Galen) thought thus to appear cleverer than the older logical commentators (presumably Theophrastus and Eudemus are intended), but fell far short.6 4) In 1899 Maximilian Wallies published7 an anonymous Greek scholium (of perhaps the 6th or the 7th century) on Ammonins' commentary on Prior Analytics which states that Galen "says in his Apodictic that there are four figures, because he looks at the compound syllogisms consisting of four terms (i.e., with three premisses )" rather than the simple (three-term, two-premiss) syllogisms of Aristotle. (The scholiast goes on to explain at some length how such compound syllogisms can be sorted into four groups.) It is readily seen that, given these data, two possibilities stand before us: a) Galen did actually invent the traditional fourth figure. Reports (1)-(3) are correct, and the anonymous scholiast of (4) was put on the wrong track by the fact that Galen also said that compound syllogisms of four terms can be classed into four groups. b) Galen did not invent the traditional fourth figure. Only after his time when once the indirect moods of the first figure had--somehow--become systematized into a separate "figure," was this credited to Galen by a mistake along the lines described by the anonymous scholiast. ArgumentLudwik Antoni Birkenmajer (1855-1929), following along the paths pioneered by Leopold Prowe, Maximilian Curtze, Franz Hipler, and J. L. E. Dreyer, joined them as trailblazers of Copernican scholarship in the nineteenth century. Educated in the classics and mathematics, Birkenmajer began by examining more closely the Cracow background to Copernicus's development and studying his works and annotations in books he owned or read. Birkenmajer contributed many discoveries that eventually became common knowledge, and his studies loomed over Polish research on Copernicus (...) into the 1970s. Focusing on historical context and his original insights, the essay reminds readers of his contributions (sections 1–2), relates them to discussions of Copernicus's precursors (section 3), to the debate about Maragha precedents (section 4), his reading of theUppsala Notebook(sections 2 and 5), and his account of the origin of Copernicus's heliocentrism (section 6). By means of a more critical assessment of his interpretation, the essay revises earlier accounts, rescuing the original insights that mark Birkenmajer's most important contributions to current debates and his efforts to reconstruct Copernicus's path to heliocentrism. Lehren und Lernen, verstanden als komplexe Vermittlung und Verarbeitung von Inhalten, finden immer in räumlichen Kontexten statt, die hinderlich oder förderlich sein können. Diese Räume können von ganz verschiedener Art sein und sie müssen sich keineswegs auf den Hörsaal und Seminarraum beschränken. Der Sammelband, der aus zwei Symposien des Münchner-Dozierenden-Netzwerks in den Jahren 2020 und 2021 hervorgegangen ist, möchte diese Räume erkunden, medial reflektieren und zugleich neue Räume für die Lehre eröffnen. Il volume analizza il pensiero trascendentale di Johann Gottlieb Fichte (1762-1814) nei suoi elementi costitutivi. In particolare viene messo in evidenza che l’intento principale della filosofia fichtiana è quello di edificare un “sistema della libertà”, fondato sul primato del pratico (das Praktische) e dei costitutivi pratici della coscienza umana: l’intuizione intellettuale, l’immaginazione produttiva, lo Streben ed in primis il volere. Viene quindi sottolineato che uno dei vertici della speculazione di Fichte è rappresentato dal concetto di “volere puro” che costituisce il (...) fondamento del conoscere e dell’agire, determinando la natura stessa dell’uomo e dell’assoluto. Nel volume vengono ampiamente utilizzati i nuovi testi messi a disposizione dall’edizione critica delle opere fichtiane curata da Reinhard Lauth: particolare attenzione viene data ai manoscritti di lezioni Dottrina della scienza nova methodo (1796-99) e all’epistolario intercorso tra Fichte e F.H. Jacobi sul rapporto tra la riflessione filosofica e la fede religiosa. In lieu of an abstract, here is a brief excerpt of the content:BOOK REVIEWS 497 Both theologians and philosophers need to see a completely integrated treatment of both rational and faith aspects of Aquinas's theology of creation. To this end, more work on theology as science also would be helpful. Emery's treatment of the end and subject of a science is not quite neoplatonic enough. His presentation of the subject of theology forces God, its subject in the Summa theologiae, on (...) earlier texts of Albert (49) and Aquinas (302). In I Sent. Aquinas says the subject is ens divinum, "being as related to the divine," which is much wider than God, who is the end but not subject oftheology. His model is Avicenna's ens commune as the subject of a metaphysics with God as its end. More work also must be done on the articles of faith, part of the subject of theology for Albert; but theology's proper principles for Aquinas. How primordial the articles are, and the interplay of reason and faith in knowing them, are still unresolved issues. In sum, one hopes this fine book by Fr. Emery will be the first of many helping give Thomism the new look it deserves. Centerfor Tlwmistic Studies Houston, TX R. E. Studien und Texte zur Geistesgeschichte des Mittelalters, Band 43. Leiden/New York/Koln: E. J. Brill, 1994. Pp. 489. $108.75 (cloth). This book is a revised version of the author's 1990 Habilitationsschrift at Ludwig-Maximilians-Universitat in Munich. It aims to articulate the theory of relations developed by the noted Parisian philosopher, John Buridan (ca. 1295-1358), "in connection with the extensive scholastic discussion of this problem," and, in particular, to show how the same arguments were advanced or refuted by different philosophers from "fundamentally different starting points" (ix, 59). This stems from the author's working hypothesis that the medieval debate on the nature of relations proceeded dialectically, and that Buridan's contribution to it can be better understood by taking its argumentative context into consideration. The scope of the book is wide-ranging, to say the least. Readers expecting a book about Buridan's theory of relations will find the title somewhat misleading, however, since background material and a survey of the "scholastic context" of Buridan's theory fill up the first 372 pages, with the author's presentation and discussion of the theory itself limited to the final 498 BOOK REVIEWS 75. Furthermore, the author seems to regard the relevance of the former discussion to the latter as self-evident. This is fine where the connections are fairly uncontroversial, as in the case of William of Ockham, but where they are less so, as in the cases 0f Giles of Rome, Henry of Ghent, Meister Eckhart, Durand of St. Pour~ain, and Peter John Olivi, one is left in the dark about why separate chapters are devoted to each. Giles and Olivi are not even mentioned in the chapters on Buridan. Henry and Durand make one appearance each, both in the course of the trivial observation that unlike in their theories, "consideration of the doctrine of the Trinity plays no role in Buridan's theory of relations" (399). Eckhart is mentioned a few times, but in terms so speculative as to be useless for the general reader. For example, the author finds Jan Pinborg's characterization of Buridan as a someone who "took the arbitrariness of language seriously" to be "of course... too microscopic " (393). The reason is that Pinborg allegedly failed to see the radicalization of conventionality in the fourteenth century in terms of an "epochal shift" from "the symbolic and quasi-naturalistic conception of language in the early Middle Ages," a conception that, the author parenthetically notes, "is perhaps still to be found (or further strengthened) in Bonaventure or Meister Eckhart" (ibid.). But even bracketing the question of how this description fits the latter authors, the Buridan story is more complex than this. Buridan does emphasize that spoken and written expressions signify conventionally, but he never abandons the Aristotelian/Boethian tripartite conception of language, according to which concepts are said to... Artificial intelligence increasingly executes tasks that previously only humans could do, such as drive a car, fight in war, or perform a medical operation. However, as the very best AI systems tend to be the least controllable and the least transparent, some scholars argued that humans can no longer be morally responsible for some of the AI-caused outcomes, which would then result in a responsibility gap. In this paper, I assume, for the sake of argument, that at least some of (...) the most sophisticated AI systems do indeed create responsibility gaps, and I ask whether we can bridge these gaps at will, viz. whether certain people could take responsibility for AI-caused harm simply by performing a certain speech act, just as people can give permission for something simply by performing the act of consent. So understood, taking responsibility would be a genuine normative power. I first discuss and reject the view of Champagne and Tonkens, who advocate a view of taking liability. According to this view, a military commander can and must, ahead of time, accept liability to blame and punishment for any harm caused by autonomous weapon systems under her command. I then defend my own proposal of taking answerability, viz. the view that people can makes themselves morally answerable for the harm caused by AI systems, not only ahead of time but also when harm has already been caused. In order to build on the information that was obtained in the course of the first study, a follow-up survey was conducted first by phone and subsequently in a written form between August and October 2014. We contacted 1.858 hospitals in all of Germany for the follow-up survey by phone. In cases where a hospital had not participated in the first study, the willingness to participate in the follow-up survey was established in advance. The survey’s dispatch was ensured in the (...) case of acceptance. The same structured survey was used as a research tool. The data of the first study and the follow-up survey were merged and evaluated. 654 surveys could be evaluated altogether. Our survey by phone revealed that 912 hospitals in all of Germany have at least one form of clinical ethics consultation available. The health care ethics committee is the most frequently implemented structure of clinical ethics consultation. The implementation of clinical ethics consultation is dependent on sponsorship and hospital size. Recommendations to deliver structures of clinical ethics consultations have a smaller influence on the implementation compared to the certification by KTQ respectively proCum Cert. The rate of implementation in regard to the structures of clinical ethics consultation has steadily increased for years. The establishment of clinical ethics consultation in German hospitals should be further promoted. It would be desirable further to develop suitable juridical regulations in order to implement clinical ethics consultation as well as structural parameters. (shrink)
